The Five Steps From Delinquency to Property Tax Foreclosure:

  1. You get served legal notice that you are being sued for delinquent property taxes
  2. You go to trial. If you lose or don’t show up, the court issues judgment in favor of the county
  3. The county notifies the public that property foreclosure sale will happen in 21 days
  4. County can submit order of sale and have sheriff or constable post the property for sale
  5. The county can sell the property. Start to finish, these steps can take as few as 118 days!

If you haven’t paid your taxes by your court date, a judgment will be found against you for the amount of your inflated tax bill. The court will then authorize the taxing entity to foreclose on the property. At this point, there is no negotiating with the court, no matter what your reasons for not paying. The county then officially posts your property for foreclosure at least 21 days in advance and then auctions off the property on the first Tuesday of the month, following the 21 day notice.
